Reservation Agreement Terms
You understand and acknowledge that as you have agreed a conditional auction sale, then you, as the Seller and Buyer, shall be legally obliged to enter into a reservation agreement and shall complete within 56 working days of the end of the auction.
The Seller agrees that the Reservation fee will be repaid if the Buyer has been unable to exchange within the Reservation Period for any of the following reasons:
Mortgage
Where the purchaser's mortgagee values the property at less than the purchase price or requires a retention from the mortgage advance and where attempts to renegotiate the purchase price are unsuccessful, the reservation fee will be refunded subject to evidence being provided in the form of the Mortgage valuation or survey. Should the property return a "nil" valuation with a request of further investigations and reports, then the named supporting documentation would be required prior to any refund discussion.
Related Sale
Where the purchaser has a related sale and is unable to complete on that sale, through no fault of their own, due to the withdrawal of any buyer within their chain.
Should the purchaser choose to withdraw from their related sale, there will be no refund of the reservation fee.
